The Supreme Court has fixed October 23 as date for the hearing the petition of the Presidential Candidate of the Peoples Democratic Party, Atiku Abubakar against the election of Bola Tinubu.
The Supreme Court Registrar, Zainab Garba, made the announcement in a notice on Thursday.
read, ”Take notice that the above appeal/motion will be listed for hearing before the Supreme Court of Nigeria sitting at Abuja on Monday, October 23, 2023.
“And further take notice that in accordance with Order 2 Rule 1(2) of the Supreme Court Rules 1985, as amended, this NOTICE is deemed sufficiently served on you if it is left at your address of service or sent by registered post and since the date of service by post is material, Section 26 of the Interpretation Act, 1964 shall apρly.” The notice read
Atiku emerged second in the result of the election announced by the Independent National Electoral Commission which returned President Bola Tinubu of the ruling All Progressives Congress as the winner of the election.
Not satisfied with the outcome of the election, Atuku filed a petition at the presidential election tribunal where he sought to nullify the February 25 election.
But the tribunal dismissed the petition for lack of merit.
Not deterred Atiku approached the Supreme Court to pursue his case against Tinubu’s election.
