A Sharia Court of Appeal in Kaduna State has upheld a suit, paving way for an order of an upper Sharia court ordering the auctioning of properties belonging to Mahmood Sha’aban, a former House of Representatives member.
The court in Kaduna State on Wednesday struck out the appeal suit the former lawmaker filed.
In February, an upper Sharia Court in Zaria had delivered a verdict that five properties located in Kaduna and Kano be auctioned over the alleged failure of Sha’aban to repay some debts.
The court added that the properties would be sold to settle the debts allegedly owed by Sha’aban.
The properties are lands and structures around the government reserved area (GRA) in Zaria, Kaduna State and another in Kano.
Following the verdict of the upper Sharia court, Sha’aban filed an appeal in the Sharia court of appeal.
At the appellate court on Wednesday, the former lawmaker’s appeal was struck out because of the lack of jurisdiction.
The court held that the upper Sharia court had unlimited jurisdiction in matters of debt recovery.
