
A five-man panel of the Supreme Court led by Justice Uwani Abba-Aji dismissed the appeal following the withdrawal of the suit by the Governor.
Counsel to the Fubara, Yusuf Ali Ali filed the notice of withdrawal to indicate the governors decision to discontinue the case.
The lawyer in the notice stated that the matter has been overtaken by events.
Justice Uwani Abba-Aji consequently dismissed the appeal and awarded a cost of two million naira against the governor payable to the Rivers State House of Assembly as the first respondent and Martin Amaewhule as the second respondent.
The Notice filed on February 6, 2024 reads. “TAKE NOTICE that the Appellant herein intends and wholly withdraws his Appeal against all the Respondents in this appeal, the appeal has been overtaken by events.” The notice reads.
