Recall that after the judgment of the Court of Appeal that affirmed the removal of Sen. Anyanwu as National Secretary of the Party, Sen. Anyanwu immediately issued a statement that he has a judgment that allows him to stay in office.
However, in a dramatic twist, Sen. Anyanwu has filed two (2) separate Motions for stay of execution of the judgment. (see attached)
Curiously, the judgment of the Court of Appeal is a Declaratory judgment and there cannot be stay of execution of the judgment.
The only legally permissible leeway to stop declaratory judgment is via injunction pending appeal. Therefore, the two motions filed so far by Sen. Anyanwu are grossly incompetent.
It is therefore, impossible to hold on to something that doesn’t exist. Sen. Anyanwu should stop this despicable behavior and leave office while he pursues his appeal at the Supreme Court.
Afterall, when he had a favorable judgement from the High Court (although this is arguable, depending on which side of the prism you’re looking from) he was allowed to enjoy all the privileges accrued, now that the Appeal Judgement favors someone else, then, that person-whoever the person is; must also be allowed to enjoy same and assume office.
On many occasions, Sen. Anyanwu has boasted that he does not like this job, he has even bragged to his colleagues that this NS Job is distracting him from his business, so why the desperation to hold on by hook-n-crook.!!
Sen. Anyanwu should stop this madness as his current desperation is liken to that of Sen. Ali Modu Sheriff.!!!!
